Reese Witherspoon and husband Jim Toth were arrested early Friday morning in Atlanta.

Hollywood agent Jim Toth, was allegedly driving drunk when the Georgia State Police  stopped his car and arrested him.   

Witherspoon, 37, was arrested on a charge of disorderly conduct early Friday after the trooper said that she wouldn’t stay inside the car while Toth was given a field sobriety test.  She was released from jail after the incident and was in New York on Sunday night for the premier of her new film, featuring Matthew McConaughey, ‘Mud’.

According to the officer’s report, before the sobriety test began, Witherspoon got out of the car, was told to get back in and obeyed, after she got out a second time, the trooper said he warned her that she would be arrested if she left the car again.  As the officer continued to test Toth, “Mrs. Witherspoon began to hang out the window and say that she did not believe that I was a real police officer.  I told Mrs. Witherspoon to sit on her butt and be quiet,” This according to Trooper First Class J. Pyland’s report.

The report continues, Witherspoon got out and asked the trooper what was going on.  After being told to return to the car, ‘stated that she was a U.S. citizen and that she was allowed to stand on American ground. 

Toth,42, was placed under arrest and is being charged with driving under the influence and failure to maintain the lane.
